Five Districts, No Law: Why in Appenzell Rhodes-Inner the District Assembly Decides on Sex Work – Not the Canton (2026)
Whoever searches for the rules governing sex work in Appenzell Rhodes-Inner will first encounter a blank: The canton has no dedicated prostitution or sex trade law. No statute, no cantonal licensing requirement, no reporting office created specifically for this trade. This is often misunderstood as either „everything is banned here1. Clarify your status. Swiss citizen, C/B permit, EU/EFTA in registration procedure, or third country national? This determines whether and how you’re allowed to work at all – the Migration department is responsible.
2. AHV before the tax office. Have your self-employment recognized by the compensation fund before the first tax period begins.
3. Check premises – with the district. As soon as a studio, a rented apartment for commercial purposes, or a business operation comes into play, zone compliance must be clarified with the district council. In purely residential zones, usage conflicts can result otherwise.
4. Operating a business requires a permit. Anyone running a venue, employing staff, or serving alcohol needs the corresponding trade/hospitality permit from the district.
5. Use advisory services. For health, safety, and legal questions, the AHSGA in St. Gallen is the regional contact, which also covers Appenzell.
Where to get binding information
This text organizes responsibilities – it does not replace official government advice. Because in Appenzell Innerrhoden much happens at the district level and nothing is consolidated in a sex work law, the binding answer depends on who exactly is asking and where exactly work will take place. Reliable sources are:
- the cantonal Migration/Foreigners department (Justice, Police and Military Department) for residence and registration procedures,
- the district council of the relevant district for zoning, building, and trade matters,
- the cantonal AHV compensation fund for recognition of self-employment,
- the cantonal tax office for declaration,
- the AHSGA for health and work-related advice.
Appenzell Innerrhoden is not silent because it has nothing to say. It is silent because the rules that other cantons write into a sex work law are distributed here across three perfectly ordinary levels: federal, district, and compensation fund. Whoever knows these three knows the legal situation – even without the paragraph that never existed.
