Anyone working in sex work in the canton of Obwalden often searches for that one permit that simply doesn’t exist here. Obwalden has no dedicated prostitution or sex work law. What it does have instead are two buildings in Sarnen, less than ten minutes’ walk apart, and in both of them decisions are made about your income: the compensation fund office on Brünigstrasse and the tax administration on St. Antonistrasse.
That sounds less dramatic than a permit requirement. In practice, it isn’t. Because what these two offices hold on file about you determines not only how much you hand over, but also whether you’ll have a pension later, whether you qualify for premium reductions, and whether your status as self-employed is even recognized at all. This article goes through step by step what applies in 2026 – and where you need to actively ask the responsible office instead of relying on a number from the internet.
The question before all others: are you self-employed under social security law?
In cantons without a sex work law, the AHV status question is the actual turning point. It determines who bills, who is liable, and which insurances apply.
Under social security law, you are self-employed if you work under your own name and for your own account, are in an independent position, and bear your own economic risk. The compensation fund office examines these three criteria – not you, not your salon, not your tax adviser.
This is the point where many are surprised. The status doesn’t depend on how a contract is titled. It depends on what the working relationship actually looks like:
- Do you set prices, working hours, and clients yourself?
- Do you bear costs that fall on you if revenue drops – rent, advertising, travel?
- Do you work for multiple clients or effectively just one business?
- Does the business set shifts, rates, or presence requirements?
The more a business provides infrastructure, prescribes procedures, and determines who may work when, the more likely the fund office may consider the work dependent. Then the business becomes responsible for billing – with employer contributions, payslips, and the corresponding consequences. This classification is made case by case and can differ for the same person depending on how they work: as an independent escort, possibly not as an independent when working in a salon with a fixed shift schedule.
Important for you as someone affected: an assurance from the salon is not recognition. Only an order from the compensation fund office is binding.
Registration with the Obwalden Compensation Fund
The responsible office is the Compensation Fund / Disability Insurance Office Obwalden (AKOW), Brünigstrasse 144, 6061 Sarnen, telephone 041 666 27 50, [email protected]. It provides information sheets and the registration form for self-employed persons online.
The fund examines at registration whether the criteria are met. Expect that you must provide evidence – not just claims. Useful documents include: a description of your work, evidence of your own client acquisition (ads, website, profile), rental contracts or invoices for premises, receipts for your own investments, and if available, invoices from multiple clients.
You should register as soon as you start the work, not when the first tax return comes due. Retroactive contribution assessments are the most common reason for unpleasant demands for back payment.
If you live in Obwalden and actually do the work here, you’re dealing with a manageable landscape of offices – but they don’t converge at a single counter. How the compensation fund office, migration, and municipalities divide responsibilities is broken down in our overview of the three Obwalden offices.
What you pay in contributions in 2026
For self-employed persons in 2026, there is a decreasing contribution scale from 5.371 to 10 percent of annual earned income for AHV, IV, and EO. The full rate of 10 percent applies from a higher income level; with lower incomes you fall into the reduced scale. The minimum contribution is CHF 530 per year – even if the business year was poor.
Plus:
- Administrative cost contribution from the fund, as a percentage of contributions.
- Contribution to the Family Allowance Fund (FAK): self-employed persons in the canton of Obwalden are obligated to contribute; the rate in 2026 is around 1.4 percent of applicable income. The binding source is the annual contribution overview from AKOW – check the current rate there instead of relying on a figure from a comparison portal.
In return, if you have children you are entitled to family allowances. Obwalden, with published rates of around CHF 220 child allowance and CHF 270 training allowance per month, is slightly above the federal minimum. The AKOW publishes the rates annually in the information sheet „Family Allowance Rates“ – that is the source that counts.
What you don’t have as self-employed
This is the part no authority explains on its own:
- No unemployment insurance. Self-employed persons cannot insure themselves against unemployment. If revenue disappears, there is no daily allowance.
- No mandatory accident insurance under the UVG. Accidents are covered by your health insurance, provided you included accident coverage there, or through voluntary UVG insurance.
- No mandatory occupational pension fund. The second pillar is voluntary for you.
On the other hand, you may contribute to pillar 3a up to 20 percent of earned income, maximum CHF 36,288 in 2026, as long as you are not affiliated with an occupational pension fund – compared to CHF 7,258 for employees with a pension fund. This is the most effective legal tax deduction this profession knows, and at the same time the replacement for the missing second pillar. If you have years with good revenue, you shouldn’t leave it unused.
Provisional payment today, final settlement later
The fund initially sets provisional contributions based on estimated income. The final settlement follows only after the tax administration reports the legally assessed income. This tax notification is the bridge between the two Sarnen addresses: your tax return ultimately determines your AHV bill.
From this follows a simple but often disregarded rule: notify the fund if your income increases significantly. Otherwise the difference comes in one lump sum one or two years later – in a profession with highly volatile income, this is the classic path to enforcement proceedings. Set aside social insurance contributions consistently alongside your tax amount.
The tax side: Obwalden’s flat rate and what it means for irregular income
Responsible is the Tax Administration Obwalden, St. Antonistrasse 4, 6060 Sarnen, telephone 041 666 62 94.
Obwalden introduced a flat rate tax in 2008, the first canton to do so: the simple income tax for natural persons is calculated at a uniform rate of 1.8 percent on taxable income. The system is still progressive because deductions and social deductions have stronger effect at lower incomes – and because federal direct tax remains progressive anyway.
The cantonal and municipality tax rates are applied to the simple tax. Obwalden has seven municipalities with different tax rates; where you are registered makes a real difference. The tax administration publishes an overview of tax rates over the years – use the numbers from there and not from real estate calculators that regularly confuse cantonal and municipal rates.
Deadlines and tools
- Taxpayers receive a letter with an identification code for electronic submission at the end of February.
- It is submitted via eTax OW / steuerportal.ow.ch, fully electronic and without signature.
- Extension of deadline is handled electronically via efristen.ow.ch and is free of charge.
- Whoever doesn’t respond at all pays: a fee of CHF 30 is charged for the second reminder – and ultimately you face assessment at discretion, which almost always turns out more expensive than an honest declaration.
Whoever activates the tax portal can see the current status of invoices and payments via the eTax account. For income that fluctuates monthly, this is the most practical control available.
Recording what counts
As a self-employed person you are required to record your income and expenses completely and truthfully. You must document the revenue, not the identity of your clients. A simple, consistently maintained journal with date, amount, and payment method plus receipts for expenses is usually sufficient. Tax data are subject to official secrecy.
Deductible are business-justified costs: rent for work spaces, advertising and platform fees, travel costs to work locations, work tools and hygiene items, further training, professional insurance – and paid AHV/IV/EO contributions. What is also used privately can only be deducted proportionally. The tax administration clarifies where the line is in individual cases; it also provides advance information on this.
VAT: the threshold at CHF 100,000
You become subject to VAT from a worldwide annual revenue of CHF 100,000 from non-exempt services. Registration with the Federal Tax Administration must take place within 30 days once the obligation arises. The standard rate is 8.1 percent. Accounting is done electronically via the ESTV ePortal, standardly quarterly, since 2025 annually on request. If you don’t want to manage the input tax settlement, you can examine the simplified gross tax rate method.
A practical note: the threshold is reached faster than many assume if multiple income sources – escorting, camera income, subscription platforms – are added together. What counts is total revenue, not the individual source.
If you’re only touring
For EU/EFTA nationals without residence in Switzerland, the notification procedure applies: up to 90 working days per calendar year without a residence permit, but never without notification. In Obwalden, the responsible office is the Migration Department in the Employment Office, St. Antonistrasse 4, 6061 Sarnen, telephone 041 666 66 70.
Under social security law, much depends on one form: if you remain self-employed insured in your country of residence and only temporarily provide services here, you demonstrate this with a Certificate A1. Without an A1, confirmation of registration with a Swiss compensation fund office is required. A health insurance confirmation is explicitly not sufficient.
The notification deadline is not the same for everyone either: for self-employed service providers and seconded employees established abroad, notification must be given at the latest eight days before work begins, while independent taking up work here is treated differently. Which case applies to you is not a formality – we have broken down the Obwalden notification requirements in detail.
Tax-wise, limited tax liability in Switzerland can also arise without residence, for example if permanent facilities are used here. This is constellation-dependent and belongs before the tax administration, not in a blanket rule. The touring model itself doesn’t become cheaper from this – how travel costs and short-term rentals affect the margin shows the comparison of several cantons in twelve days.
Source tax: why it usually doesn’t apply to self-employed persons
Source tax affects foreign employees without settlement permit C with tax domicile or residence in the canton – specifically for income from dependent employment. If you work as a recognized self-employed person, you are assessed normally and file a tax return.
If, on the other hand, you are classified as an employee by a business, the new withholding tax rate applies in Obwalden for 2026, with a minimum tax of CHF 3 and an unchanged commission of 1 percent for the employer; billing is done online. This is another reason to clarify your status early: it determines which tax procedure applies at all.
The third bill that comes from the same assessment
Since October 15, 2025, premium subsidies (IPV) in the canton of Obwalden have been based at the compensation fund. This closes the circle: the calculation basis is the final tax assessment – for the IPV 2026, that of the year 2024. The registration deadline is May 31; anyone who submits the form later forfeits their claim for the year.
This leads to the most important financial advice in this article: if you don’t file your tax return, you save nothing. Without assessment, there is no basis for premium subsidies, contributions are estimated at the authority’s discretion, and AHV gaps remain. The three bills – AHV, taxes, health insurance premium – depend on a single document.
Where the canton is moving in 2026
Two construction sites are worth attention:
Total revision of the EG AHVG. The government council has opened the consultation on the total revision of the cantonal implementing law to the AHVG; statements were possible until March 10, 2026. Planned are a cantonal social insurance institution and an administrative commission that will replace the oversight of the government council and department. Your contribution rate won’t change as a result – but in the medium term, how the fund is managed and supervised will.
New Planning and Building Law. Since March 1, 2026, the new PBG applies, and all seven municipalities are revising their building and zoning regulations. This is not a tax matter, but it determines whether your workplace is permitted at all – and thus indirectly your cost structure. Which disturbance levels apply where can be found in the overview of Obwalden zones and municipal rules.
The fact that financial issues and building law must be considered together in cantons without a sex work law is not an Obwalden special case. The neighboring canton Uri works according to the same logic – as documented in the overview of permits and responsibilities around money in Uri, and in Zug the same pattern appears in regulation via the zoning plan rather than via a sex law.
Who helps you
Obwalden has no dedicated office for sex work. Central Swiss services cover the canton:
- LISA Association, Franziskanerplatz 1, 6003 Lucerne: psychosocial counseling for people in the sex industry, explicitly also on self-employment, permits, taxes, health insurance and premium subsidies, family allowances, AHV and enforcement proceedings. For explicitly legal questions, the association is supported on a volunteer basis by a lawyer and former cantonal judge. Management transferred to Christine Guarise as of April 1, 2026.
- S&X Sexual Health Central Switzerland, Museggstrasse 27, 6004 Lucerne: specialist office for the Central Swiss cantons, HIV/STI testing and counseling, co-financed by the canton of Obwalden.
Both work confidentially and without reporting to authorities. If you’re unsure whether registration with the compensation fund poses a risk, clarify this there faster and more honestly than in a forum.
In brief
- Status first. Register with AKOW and have your self-employed status determined – not assured by the salon.
- Plan for 5.371 to 10 percent AHV/IV/EO, at least CHF 530 per year, plus administrative costs and FAK contribution.
- Report income jumps to the fund before the bill comes due.
- File your tax return, electronically via eTax OW, deadline extension free via efristen.ow.ch.
- Watch the CHF 100,000 turnover threshold for VAT across all income streams.
- No place of residence: notification procedure, A1 or registration confirmation – before starting work.
- By May 31, apply for premium subsidies with AKOW.
- Use pillar 3a – up to 20 percent of income, maximum CHF 36,288 in 2026.
Information from the responsible office is always binding: the Obwalden compensation fund for contribution status and social insurance, the Obwalden tax administration for all tax matters, the Migration department for residence and notification procedures, and your residential or business municipality for everything related to premises. Rates, deadlines and rates are adjusted annually – a call costs nothing, a wrong assumption sometimes costs a year’s income.
