Twenty Days During Which the Entire Canton Can Have a Say
If someone in Appenzell Innerrhoden wants to open a salon, they first look for the form. There isn’t one. The canton has no separate prostitution law, no salon permit, no operating register for the sex industry. When someone calls a government office asking about the „permit for an erotic establishment,The most consequential requirement is not found in any cantonal decree. It arises from federal court practice on the de facto employer concept, as summarized in the Swiss State Secretariat for Migration’s report on red-light issues with reference to BGE 128 IV 170: Whoever provides services in a salon for an operator does not, according to this case law, often work independently but rather for an employer in the legal sense. The threshold is low — requirements regarding presence times, the selection of who works in the salon, or centrally managed advertising are sufficient in practice to establish an employment relationship.
For a business in Appenzell Innerrhoden, this has three consequences that no one announces in advance:
- Social insurance. If workers are classified as employees, the business is an employer and thus required to settle accounts with the Appenzell Innerrhoden compensation fund (AKAI, Poststrasse 9, 9050 Appenzell). Back payments are made retroactively. How the contribution side for the self-employed looks — and why the money is usually already spent when the invoice arrives — is a separate story.
- Foreigner law. If the business is an employer, the registration or permit obligation for employees from the EU/EFTA area lies with it, not with the workers. The registration procedure applies to gainful activities up to 90 working days per calendar year; beyond that, a permit procedure is required. In Appenzell I.Rh., the competent authority is the Population Services department. The concrete design — who registers, by when, via which channel — should be clarified there before the first hire, not after.
- Labor law. With employer status come working time regulations, night work permits, and occupational health and safety requirements.
Anyone wanting to avoid this constellation must actually allow genuine self-employment: independent pricing, independent clientele, independent advertising, independent time management, a clear rental agreement for space and infrastructure rather than revenue sharing. Label fraud — a rental agreement on paper, employer authority in practice — is precisely the pattern that case law qualifies as employment.
Criminal law guidelines
Three points of federal law apply regardless of any cantonal regulation:
- Art. 195 StGB (promotion of prostitution) protects freedom of action. Anyone who restricts a person’s freedom of action or exploits their dependence is liable to prosecution. The rental itself is not the problem, but rather control over prices, clientele, times, or working conditions in connection with a situation of dependence.
- Art. 199 StGB penalizes the unlawful practice of prostitution — that is, violation of cantonal or municipal provisions on the place, time, and manner of practice. In Innerrhoden, in the absence of its own prostitution law, this essentially relates to building and police law.
- Contract law. The Federal Court held in a 2021 ruling (6B_572/2020) that contracts for sexual services are no longer to be considered contrary to public policy. For businesses, this means: claims arising from such relationships are generally enforceable — in both directions.
How much is controlled — and what the figures show
A realistic picture of inspection frequency is provided by the 2025 police crime statistics, which the Appenzell Innerrhoden cantonal police published on March 23, 2026: a total of 663 registered offenses, of which 611 fall under the Criminal Code — an increase of just over 16 percent compared to the previous year. And explicitly: Despite several inspections on construction sites, in the hospitality industry, and in the service sector, as well as vehicle and personal checks, no violations of the Foreigners and Integration Act were found.
Two things can be read from this. First: there is inspection, including in the service sector, and not specific to the sex industry but across all sectors. Second: the canton does not report a noticeable number of cases in this area. Anyone who concludes from this that no one is looking anyway confuses a low case count with low inspection density.
The practical sequence
For anyone planning a salon or erotic business in the canton of Appenzell Innerrhoden, all of this results in a sequence that cannot be rearranged:
- Clarify the zone before signing a rental agreement. Sensitivity level and zoning assignment determine whether a permit is possible — afterwards it is too late.
- Pre-meeting with the building administration (Inneres Land AI or District Administration Oberegg). The building administration advises on the submission and coordinates the procedure.
- Submit a building permit for the change of use, plan the publication schedule, factor in a twenty-day public notice period and legal challenge window.
- Fire safety should be considered in parallel: escape routes, fire compartments, occupancy.
- Hospitality business only if alcohol is actually dispensed for payment — otherwise consciously refrain from it.
- Status of workers must be clearly established before the first person starts. Self-employed or employee is not a matter of preference but a legal consequence.
- AHV and taxes must be clarified in advance — both as a business and as a working person.
Who asks the same question one canton further finds a similar but not identical pattern: In Appenzell Ausserrhoden, the zoning plan also determines the permit, and in the canton of Uri it is also factually the residence and not the canton that determines admissibility.
Where to ask
Only the competent authorities can provide binding information — and in Innerrhoden there are several:
- Building Administration Inneres Land AI for building permits in Appenzell, Schwende-Rüte, Schlatt-Haslen, and Gonten; District Administration Oberegg for the Oberegg district.
- District Administration of the respective district for hospitality permits.
- Employment Office Appenzell I.Rh. or Labor Inspectorate AR in Herisau for labor law, night work, and undeclared work issues.
- Appenzell Innerrhoden Compensation Fund (AKAI), Poststrasse 9, 9050 Appenzell, for contribution status.
- Population Services department for foreigner-related registration and permit issues.
For workers themselves, there is additionally low-threshold, confidential counseling in eastern Switzerland — MariaMagdalena in the canton of St. Gallen and Aids-Hilfe St. Gallen-Appenzell. That this network does not end at the cantonal border is also evident in the neighboring canton, where the contact points for sex workers in Appenzell Ausserrhoden are described in detail.
Conclusion
The question of permits and requirements for salons and erotic businesses in the canton of Appenzell Innerrhoden has no one-word answer because the canton deliberately has no special regulation for this trade. What looks like a gap is in practice not a free space but a shift: instead of a sex-trade-specific permit with clear criteria, general law applies in its full scope — and this general law is stricter in Innerrhoden in one respect than elsewhere.
The twenty-day public notice period combined with the popular challenge turns a permit procedure into a public matter. The Grand Council explicitly retained this instrument in the revision, and the Landsgemeinde approved the revision. Whoever plans for this can work legally and properly in Innerrhoden. Whoever banks on no one noticing has overlooked the decisive procedural element — namely, the one the canton is least willing to give up.
And whoever wants to know which authorities individual questions should actually go to will find an overview of where sex workers in Innerrhoden should really turn.
